Facts
:
1. Vide RTI application dated 2.12.2008 addressed to the
CPIO, LIC of India, Divisional Office, Hazratganj, Lucknow,
the appellant Shri Ganesh Chander Valmiki sought information
pertaining to payment of his death claim in respect of Shri
Chhote Lal Valmiki.
2. Not receiving response from the CPIO, the appellant
preferred appeal before the FAA dated 20.12.2008 which was not
adjudicated upon.
3. Being aggrieved and not satisfied, the appellant
preferred complaint before the Commission.
4. The matter was heard today through video conferencing.
Respondent was present as above. Appellant did not appear.
5. As per the statement of respondent the CPIO had responded
to the RTI application vide his letter dated 15.1.2009 in
which he informed the appellant that claim papers duly
authenticated by Nagar Palika Parishad had not been received
by them. CPIO stated that even today claim papers had not
been received by them but offered to have the claim processed
on the basis of duplicate set of papers if the same was
provided to them by the appellant.
Decision
6. The appellant is directed to provide a set of claim
papers to the CPIO within 2 weeks of receipt of the order.
Commission takes notes of the statement made by the appellant
in para2 of his RTI application that the said claim papers
have been duly forwarded by the Nagar Palika Parshid and
several reminders have also been sent by them to LIC but the
matter has been pending for over 5 years. In view of this,
CPIO is directed to provide copy of his letter dated 15.1.2009
addressed to the appellant along with proof of dispatch to
the appellant copy to the Commission within 2 weeks of
receipt of the order (giving reference of this case No.
CIC/SM/C/2009/000880).
7. On receipt of this information Commission will take a
view regarding issue of show cause notice to CPIO.
