Facts
arising from the Complaint:
The Complainant had filed an RTI application dated 31/01/2011 with the aforementioned Respondent
PIO, asking for certain information. However on not having received the information within the
mandated time; the Complainant filed a complaint under Section 18 of the RTI Act with the
Commission on 30/05/2011. On this basis, the Commission issued a notice to the aforementioned
Respondent PIO on 02/06/2011 with a direction to provide the information to the Complainant and
further sought an explanation for not furnishing the information within the mandated time.
The Commission is in receipt of a copy of letter dated 14/06/2011 from the Deputy Commissioner,
MCD, Central Zone, addressed to the S.E. (E&M), MCD Civil Lines Zone, stating that since the
original RTI application was transferred to the office of EE (E&M)- II, the concerned officer should be
directed to provide the requisite information. Subsequently the Commission received a copy of letter
dated 29/06/2011 from Executive Engineer (E&M) – II, addressed to the Deputy Commissioner,
MCD, Central Zone; stating that the information pertains to the EE ( E&M) TY Division.
Decision:
The Complaint is allowed.
In view of the aforesaid, the PIO & EE (E&M) TY Division is hereby directed to provide the
complete information with regard to the aforementioned RTI Application, to the Complainant before
30th August 2011 with a copy to this Commission. In case the information is not available with the
PIO, the PIO shall seek assistance under section 5 (4) of the RTI Act from any other officer, and
provide the requisite information to the Complainant.
Notice of this decision be given free of cost to the parties.
Any information in compliance with this order will be provided free of cost as per section 7(6) of RTI, Act, 2005.
