2. We heard this case through audio conferencing. The Appellant was heard over
phone. The Respondents were present in our chamber. We heard their submissions.
3. The Appellant had sent copies of two complaints he had made way back in the
year 2000 and 2001 and had wanted to know about the action taken on those two
complaints. His application had been transferred by the PMO to the Ministry of Labour
which, in turn, had transferred it to the relevant office for providing the desired
information.
4. The Appellant claimed that he had received no response from anywhere about
the fate of those complaints. He was specially exercised over the fact that his
complaints against the functionaries of the Labour Ministry had been sent back to the
Ministry itself for enquiry when he had expected the PMO to conduct an enquiry
independently. On the other hand, the Respondents submitted that, as a matter of
practice, the PMO forwarded such complaints or representations to the respective
ministry for further followup action. The representatives from the Labour Ministry
submitted that the complaints dating back to the year 2000 and 2001 were no longer in
existence having been weeded out as per the retention policy of the Ministry and,
therefore, it was not possible for them to find out what exactly had happened.
5. In the light of the above, we do not think that there is any further information
which could be provided. However, we would like to advise the Appellant that, if he so
chooses, he may send those complaints again to the Labour Ministry for enquiry and
further necessary action.
6. The appeal is disposed off accordingly.
7. Copies of this order be given free of cost to the parties.
