         The Complainant was not present in spite of notice.

         On behalf of the Respondent, Shri Dargahi Singh was present.

2. In our order dated 26 November 2009, we had directed the CPIO to 

provide the desired information to the Complainant within a certain time limit 

and also to explain why penalty should not be imposed on him for the delay in 

providing the information. In this case, the RTI application was preferred on 19 

July 2008 at the branch level and the CPIO had provided the information on 4 

December   2008,   nearly   5   months   later.   This   is   clearly   a   case   deserving 

imposition of penalty in terms of Section 20(1) of the Right to Information (RTI) 

Act.

3. During   the   hearing   today   conducted   through   videoconferencing,   the 

present CPIO was present in the Lucknow studio of the NIC. He submitted that

he was not responsible for the delay in this case as he had taken over as the 

CPIO only on 1 October 2009 after the retirement of the previous CPIO who 

had handled this case. In these circumstances when the officer concerned has 

already retired, nothing much can be done to penalise him. We would expect 

however   that   the   Bank   would   take   appropriate   steps   to   ensure   that   RTI 

applications are attended to promptly and the information provided within the 

stipulated period of 30 days. The present CPIO assured us during the hearing 

that he  would  abide by the provisions of the Right to Information (RTI) Act 

without fail. The case is disposed of accordingly.

4. Copies of this order be given free of cost to the parties.
