Background
1. The Applicant filed his RTI request on 07.07.08 with the PIO / North Eastern Railway,
Lucknow requesting for information related to appointment to TC/BC post and also
related to his promotion, seniority etc. The PIO replied on 28.07.08 providing him
with point wise information received from APIO vide his letter dated 25.07.08. Not
satisfied wit the reply, the Applicant filed his First Appeal on 02.09.09 commenting on
the information given against each point and stating that it is incomplete. On not
receiving any reply from the Appellate Authority, the Appellant filed a Second Appeal
before the Commission stating that after being selected in reserve category he has
still not been appointed to the post and requested for the information on action taken
in this regard.
2. The Bench of Mrs. Annapurna Dixit, Information Commissioner scheduled the
hearing on 26th November, 2009.
3. Mr. Jagdish, Sr. EDPM & CPIO, Mr.A.K. Dadarya, ADRM & Appellate Authority and Ms.
Indu Dubey, Sr. DCM represented the Public Authority.
4. The Applicant was present during the hearing.
Decision
5. The Appellant submitted that all that he wants is to know why two colleagues who
have been promoted along with him have been shown higher in the seniority list
whereas his name has been shown below them and why they have been taken back
whereas he is a booking clerk. On hearing the submission of the Respondents , the
Commission directs the CPIO to allow inspection of files of the his two colleagues, by
the Appellant, so that he may get information about why they have been taken back
in the commercial section whereas he hasn’t and to provide him with certified copies
of information he requires. The inspection to be over by 25th December, 2009 .
Information against point 2 with regard to his promotion in BC has already been
provided on 23.07.08 by the Appellate Authority. The appeal is accordingly disposed
off.
