This   matter   came   up   for   hearing   on   24.09.2010.     Appellant  
was   absent   when   called,   while   the   respondents   were   represented   by  
Shri M.V.Krishnamurthy, AGM and Ms.Lakshmy Iyer, Deputy Manager.

2. Appellant’s RTI­application dated 27.07.2009 read as follows:­

“Subject matter of information:­

Regarding   candidates   being   declared   Medically   unfit   in   Medical  
Examination held for Recruitment in Clerical Cadre (Ad.No.CRPD/  
CD2008­09/1) and subsequent appeal to Medical Board by these  
candidates declared unfit.

Description of the information required:­

“1) List of the candidates declared unfit by the Medical Officer  
for above mentioned recruitment.   Documents in support of  
them being medically unfit.

  2) List   of   Candidates   who   appealed   to   the   Medical   Board  
against the above mentioned decision.

  3) Composition of the Medical Board, Names, Designation and  
Qualification.

  4) List   of   candidates   who’s   appeal   was   accepted   and   the  
reasons there of along with copies of supporting documents.

  5) List of candidates  who’s  [sic] appeal  was  rejected  and the  
reasons there of along with copies of supporting document.”

3. Through   CPIO’s   communication   dated   17.08.2009   and   Appellate 
Authority’s   order   dated   29.09.2009,   appellant   was   provided   some 
information relating to the above queries.  The information, which was left 
out, was the names of the candidates (Sl.Nos.1, 2, 4 and 5), the medical 
reports about the health conditions of those candidates and the names of 
the   Members   of   the   Medical   Board   along   with   their   designations   and 
qualifications.

4. Respondents were right in holding up the information relating to the 
reports of the Medical Board and the health condition of the candidates 
examined, as these come within the scope of Section 8(1)(j) of the RTI 
Act.

5. However,   there   is   no   reason   why   the   list   of   the   candidates 
requested through queries at Sl.Nos.1, 2, 4 and 5 and the names of the 
Members   of   the   Board   along   with   their   designations   and   qualification 
should be denied to the appellant.   These are not barred by any of the 
exemption Sections.

6. It   is   accordingly   directed   that   the   information   as   at   paragraph   5 
above be furnished to the appellant within two weeks of the receipt of this 
order.

7. Appeal disposed of with these directions.

8. Copy of this direction be sent to the parties.
