2. In this case, the Appellant had, in his application dated 24 November
2008, raised a large number of queries regarding the cash credit limit
sanctioned to M/s Pelican Corporation. In his reply dated 12 January 2009, the
CPIO observed that the information fell in the exempted category under Section
8(1) (d) of the Right to Information (RTI) Act and, therefore, could not be
disclosed. Against this decision of the CPIO, the Appellant preferred an appeal
on 1 February 2009. The Appellate Authority disposed of the appeal in his order
dated 19 March 2009 by endorsing the decision of the CPIO. It is against this
order that the Appellant has come to the CIC in second appeal.

3. We heard this case through video conferencing. The Appellant was
present in the Vadodara studio of the NIC. The Respondents were present in
both the the Vadodara and the Mumbai studios. We heard their submissions.
Admittedly, the Appellant has no direct relationship with the above borrower
and his CC account and, to that extent, the denial of information by the CPIO is
understandable. However, during the hearing, the Appellant submitted that the
Bank had since started recovery proceedings against the borrower and, in the
process, had included a plot of land belonging to the Appellant himself,
although the borrower had no claim on his land he having bought it from
someone else. Since this plot of land is now implicated in the recovery
proceedings, he submitted that he had a right to get the information about this
CC account. Keeping this background in mind, we think that it would be proper
if the Appellant would produce any documentary proof before the CPIO about
his ownership of the said plot of land against which the recovery proceedings
have been initiated in this case and, thereafter, the CPIO should provide the
desired information about the CC account. We direct that the CPIO shall
provide the desired information within 10 working days of the Appellant
producing before him the documentary evidence about his ownership of the
said plot of land which is implicated in the recovery proceedings against M/s
Pelican Corporation.
4. The case is, thus, disposed off.
5. Copies of this order be given free of cost to the parties.
