Background
1. The applicant filed an RTI application dt.1.12.08 with the CPIO, NIC, New
Delhi. He requested for the following information:
i) List of candidates selected in Recruitment to the post of
Scientific/Technical Assistant-B (District Informatics Associate)
(Ref.Advt.No.:15(1)/2008-Pers.) merit wise, category wise with marks in
written as well as interview.
ii) Waiting List of candidates selected in Recruitment to the post of
Scientific/Technical Assistant-B (District Informatics Associate)
(Ref.Advt.No.:15(1)/2008-Pers.) merit wise, category wise with marks in
written as well as interview.
The CPIO replied on 30.12.08 denying the information u/s 8(1)(j). Not
satisfied with the reply, the Applicant filed an appeal dt.27.1.09 with the
Appellate Authority. The Appellate Authority in his reply dt.5.3.09 directed
the CPIO to give specific reply to the query within 30 days of receipt of his
order. Aggrieved with this reply, the Applicant filed a second appeal
dt.30.4.09 before the CIC.
2. The Bench of Mrs. Annapurna Dixit, Information Commissioner, scheduled the
hearing for June 9, 2009.
3. Mr. Swarup Dutta, Scientist ‘D’ cum CPIO and Mr. S.P. Sharma, S.O.
represented the Public Authority.
4. The Applicant was not present during the hearing.
Decision
5. The Respondent submitted that the information was not provided as the
results were not declared at the time the RTI request was filed. However,
since the results were out on 13.5.09, the Commission directs the CPIO to
provide the list of selected candidates as well as the names of those on the
waiting list to the Appellant by 10th July, 2009.
6. The appeal is disposed of.
