Information sought:-
The Complainant wants the following information:-
1) 10000 Jhuggies were removed lying between Tyagraj Stadium to Jawaharlal Nehru Stadium and Khel
Gaon, when they will be rebuilt?
2) apart from the mentioned above when the other people would get their jhuugies rebuilt?
3) 250 families of Prabhu Market were issued the order from the court that the Govt. would give them the
place for living. When the state govt. will complete the following?

4) When will the 2000 families of Suraj Park, Badli be given the place for living. And when will the
people whose Jhuggies were removed be given the place for living.
5) Govt. has done development that’s good but why the rights, employment of rural people have not been
looked after. Development matters nothing after doing this. Provide the answer for the same.
6) When will the house be given under Rajiv Ratan Yojana, whose forms were filled two three years ago.
7) Whether govt. has made any plans for the labours that were hired from different parts of the world
during the commonwealth games. Provide the complete detail for the same.
8) How much money was spent on the decoration of common wealth games? Provide the complete detail
for the same.
9) Various news related to the corruption were heard few days ago. What action will be taken against
them. Provide the complete detail for the same?
10) Govt. had a dream that they would improve the condition of Delhi whether there would be a space for
those who are actually responsible for the doing so. Provide the complete detail for the same

FAA’S Order:-
The matter has been examined and accordingly the PIO is directed to provide the information in respect of
point 5 and 10 of the aforesaid RTI Application, if available with Chief Minister Office. As regards, the
other para the PIO may specifically indicate like for Rajiv Ratan Awas Yojana, the Urban Development
may be asked to do the needful. In view of the above, the instant Appeal stands disposed off.
Relevant Facts emerging during Hearing on 05 May 2011:
The following were present

“The PIO of CM’s Office has transferred the RTI application to PIO UD, PIO NDMC & PIO
Labour Department. The RTI has also been sent to PIO DUSIB. The Commission is adjourning the matter
and directs the PIOs of UD, NDMC, Labour Department & DUSIB alongwith the PIO of CM’s Office to
come prepared with the information to the Commission on 08/06/2011 at 04.00PM. The Commission
expects that they would have done some preliminary consultation before coming for the hearing, to be
able to come to the conclusion as to who has the information. If all of them claim that they do not know it
would be a very sad comment on the governance of the capital of this country.
The matter is adjourned to 08th June 2011 at 04.00PM. All the PIOs of UD, NDMC, Labour, DUSIB and
CM’s office will present themselves at the above address.”

The following were present:

Respondent (3):Mr. Rattan Singh, PIO & Dy. Director (Enforcement), NDMC;
Respondent (4):Mr. Manoj Sing, PIO & Labour Officer, Labour Department (GNCTD) and PIOs of
other districts;
Respondent (5):Mr. S. C. Vats, PIO & Dy. Director (Rehabilitation) DUSIB;
Mr. M. K. Agarwal Dy. Secretary has brought the information which he has handed over to the
Complainant. The information that he is providing appears to be shocking. In reply to queries 1, 2 & 3 of
the Complainant which mentions that there is a court order to provide dwellings to the families who had
Jhuggies in the Right of Way, the PIO has stated that the Government’s policy is that no flats should be
allotted to such dwellers. The PIO has verbally explained that the Government has filed a SLP in Supreme
Court but admits that there is no stay order which has been obtained. The implication is that since Delhi
Government feels that it wants to challenge an order of Delhi High Court it will not follow the order
though no legally valid stay has been obtained against this order. The PIO also states that a suit has been
filed against the Delhi Government for contempt of court in Delhi High Court in which hearings are going
on. This Commission is distressed that such a lawless state of affairs a Government knowingly flouts the
order of the Courts even when no stay has been obtained on such an order. Citizens would have scant
respect for the laws and orders if the Governments fail to respect these in such a manner.
The PIOs of the Labour Department have stated that there is a scheme for registered construction workers
which has been provided to the Appellant. However, there is no specific plan of the Government for the
workers who worked for the Commonwealth Games Projects.
Decision:
The appeal is disposed.
The information available has been provided.

Notice of this decision be given free of cost to the parties.
