Background
1. The Applicant filed an RTI application dt.29.11.07 with the CPIO, ECR,
Sonepur. He requested for information regarding overtime payment for
escorts in the trains. On not receiving any reply, the Applicant filed an appeal
dt.29.1.08 with the Appellate Authority reiterating his request for the
information. The CPIO replied on 7.2.08 enclosing the reply from Divisional
Railway Manager which stated that the payment would be made after the
issue is resolved. Aggrieved with this information, the Applicant filed second
appeal on 12.3.08 before the CIC.
2. The Bench of Mrs. Annapurna Dixit, Information Commissioner, scheduled the
hearing on May 13, 2009.
3. The Public Authority was not present at the hearing.
4. The Applicant was present during the hearing.
Decision
5. The Appellant stated that from 1996 to 1998, the overtime allowances were
not paid to the people working as Escorts. He further stated that the Steering
Committee which was set up in 1999 decided that since the escort works for
almost 24 hours, 6 hours should be treated as hidden rest and 18 hours as
paid. He requested for overtime from 1996 to 1998. He wanted to know the
reasons why the overtime was not paid and also the payment for 6 hours
dues which have been withheld after 1998 and for the name of the person
who is responsible for the decision. The CPIO is directed to provide
information with reference to the letter dated 17.12.07 from Central Railway,
Sonepur in which payment has been assured to the Appellant, by 10th
June, 2009 under intimation to the Commission.
6. The appeal is disposed off.
