Background

1. The RTI request was filed on 13.2.08. The Appellant requested for
information from the Chief Post Master General, Lucknow against 15
points. The CPIO replied on 13.3.08 providing some information. The
CPIO also stated that photocopies of required documents would be
provided on receipt of prescribed fee as given in the RTI Act(Para 4(ii
to iv)) The Appellant filed his first appeal on 15.4.08 stating that the
Public Authority is required to supply the information as per the RTI
Act and that information against Para 4(i) to Para 4(v) should be
provided. Aggrieved at not getting any reply from the FAA, the
Appellant filed his second appeal before the CIC on 15.7.08. He stated
that the CPIO did not arrange to provide the information and
reiterated his request for it.

2. The Bench of Mrs. Annapurna Dixit, Information Commissioner,
scheduled the hearing for December 3, 2008.

3. Both the Appellant and the Respondents were not present during the
hearing.

Decision

4. The Commission holds that:

i) Information against points 4 (v) and 4(viii) to 4(XV) is not
‘information’ as defined in the RTI Act since the Appellant is only
asking for the opinion of the Public Authority on certain matters.

ii) With regard to points (ii) to (iv), the Commission directs the CPIO to
provide the information on receipt of the prescribed fees as already
indicated in his letter dated 13.3.08 to the Appellant, within 15 days of
receipt of this Order.

ii) As for the remaining points , information has already been provided to
the Appellant.

5. The appeal is disposed off.
