ORDER
Shri Kailash Chandra Swain, the appellant has filed this appeal dated 7.3.2011
before the Commission against Food Corporation of India Workers’ Cooperative Credit
Society Ltd, Cuttack for not providing information to his RTI-request dated 24.11.2010.
The matter came up for hearing on 20.10.2011. The appellant was represented by Shri
Srinibash Sasmal, whereas no one appeared from respondent.
2. The appellant filed an RTI-application dated 24.11.2010 seeking information on
eighteen queries relating to Branch Offices of the Society. The Secretary, FCI Workers’
Cooperative Credit Society Ltd., Cuttack vide letter No. FCI/2010-11/7883 dated
29.11.2010 replied to the appellant that their Society is not the “public authority” as
enshrined under the RTI Act, 2005 and returned the IPO of Rs. 10/- to the appellant.
3. Aggrieved by the reply of the Secretary of the Society, the appellant preferred first-
appeal dated 6.12.2010 before Chairman of the FCI Workers Cooperative Credit Society
Ltd., Faridkot.
5. Having heard the appellant and perused the relevant documents in file, the
Commission is of the considered view that the respondent FCI Workers’ Cooperative

Credit Society Ltd. do not qualify to be ‘public authority’ as laid down in Section 2(h) of the
RTI Act, 2005. The said Society has no disclosure obligation to the appellant.
The matter is accordingly disposed of at Commission’s end.
