Background

1. The Applicant filed an RTI application dated 23.04.09 requesting for certified
copy of CD case C.C.No.28/2008 of Malkangiri district forum as on 15.4.09.
The CPIO replied on 19.05.09 requesting the Applicant to submit his voter ID
card as also an Indian Postal Order of Rs.5/- since only Rs. 5/- were sent with
the application. On 28.6.09 the CPIO again replied to the Applicant stating
that since the case in Malkangiri Consumer Forum was filed by the Applicant
against BSNL there is no question of BSNL giving him papers since it is the
opposite party. He also stated that the papers filed by BSNL before the
DCDRF, Malkangiri are available in the said forum only, which is not under the
control of BSNL. He denied copies of note sheets from the file. Not satisfied
with the reply, the Appellant filed his first appeal on 10.5.09 reiterating his
request for information. On not receiving any reply from the Appellate
Authority, the Applicant filed a second appeal before the CIC on 4.07.0 stating
that the CPIO has filed some forged documents in the said consumer case and
requesting for the information.

2. The Bench of Mrs. Annapurna Dixit, Information Commissioner, scheduled the
hearing for 5th October, 2009.

3. Mr. Dhanurjaya, DECP & A cum ACPIO represented the CPIO of the Public
Authority during the hearing.

4. The Applicant was not present during the hearing.

Decision

5. As a matter of Right, any document supplied to the Court by one party has to
be supplied by that party to the other party also. Accordingly, the Commission
after hearing the Respondent, directs the CPIO to provide one set of certified
copies of all documents submitted to the Court by them to the Appellant by 10
November, 2009.

6. The appeal is accordingly disposed off.
