This secondappeal was heard partly through videoconference
(VC) on 12.04.2010 in the presence of both parties. Appellant was
present at NIC VC facility at Virudhunagar, while the respondents ―
represented by Ms.Neeta Gupta, Under Secretary and Appellate Authority
and Shri Rajesh Kumar, CPIO ― were present at the Commission’s office
at New Delhi, from where the Commission conducted the hearing.
2. Appellant has sought through his RTIapplication dated 02.04.2009
certain records, files, documents and maps belonging to the years 1926
27. He was advised by the CPIO, through a communication dated
28.04.2009 and by the Appellate Authority’s decision dated 13.10.2009
that the records and documents requested by him could not be traced
and hence could not be provided. Appellant has questioned the
conclusion of the CPIO and the Appellate Authority.
3. However, I find myself unable to do anything in this regard because
as stated by the officers of the public authority, the requested information
is untraceable, possibly nonexistent.
4. As the information is not available for disclosure, there shall be no
obligation to provide it to the appellant.

5. Appeal fails. Closed.
