Background
1. The applicant filed a RTI application dt.3.6.09 with the PIO, DRM Office, North Eastern
Railway, Lucknow seeking reasons for not transferring one Mrs. Poonam Bajpai and
transferring him when the same charges have been framed against both. The PIO replied
on 26.6.09 enclosing point wise information . Not satisfied with the reply, the Applicant
filed an appeal dt.11.7.09 with the Appellate Authority requesting for complete
information. On not receiving any reply, the Applicant filed a second appeal dt.Nil before
CIC.
2. The Bench of Mrs. Annapurna Dixit, Information Commissioner, scheduled the hearing
for April 20, 2010 through video conferencing.
3. Shri Jagdish, PIO and Shri Jaydev, Sr.DPO represented the Public Authority and were
present at NIC Studio, Lucknow while the Applicant was absent.
Decision
4. The Respondents submitted that Ms.Poonam Bajpai had requested for cancellation of
her transfer on sympathetic grounds, citing school going children who would be affected
by the transfer as one of the reasons and the competent authority had accepted request
and had decided to cancel her transfer.
5. The Commission hence directs the PIO to allow inspection of the transfer file of Mrs.
Poonam Bajpai by the Appellant and to provide him with attested copies of documents he
requires free of cost by 20.5.10. The Appellant to submit a compliance report to the
Commission by 26.5.10.
6. The appeal is accordingly disposed of.
