Relevant Facts emerging during Hearing:
The following were present:
Appellant: Mr. M. A. Khan;
Respondent: Prof. Mini Thomas, Public Information Officer;
The Appellant had been given the information he has sought except the photocopy of
answersheet of his daughter. The PIO states that this was done since they believe the full bench
of the Commission has ruled that Universities and bodies of this nature and Examining bodies
which conduct examinations for very large number of students need not give photocopies of
answersheets under the RTI Act. Whereas it is true that there is such a decision of the
Commission it applies to examinations where a very large number of students appear and this
ruling has been given based on the reasoning that such bodies would file it difficult to provide
the answersheets. In the instant case the answersheet in question in one which was for an
entrance to a school and a number of candidates would be very small. In view of this the
Commission’s full bench decision will not apply to this case.
Decision:
The Appeal is allowed.
The Photocopy of the answersheets will be provided to the Appellant before 30 November 2009.
This decision is announced in open chamber.
Notice of this decision be given free of cost to the parties.
Any information in compliance with this Order will be provided free of cost as per Section 7(6) of RTI Act.
