ORDER
1. The Commission has received a petition from Shri Mahendra Meena Tripathi, stating that
his RTI-application of 18/06/2009 filed The PIO/Supdt. of Post office , D/o Post, O/o the Supdt.
of Post office, Gorakhpur, has not been responded to within the time limit prescribed under the
RTI-Act 2005. A copy of his RTI-application is enclosed. Thereafter, the petitioner

filed 1 Appeal before Appellate Authority of Public Authority. From the perusal of
documents on record, it is seen that the same has not been adjudicated upon by the First
Appellate Authority.
2. Under the circumstances, the commission has decided to treat this petition as a complaint
under Section 18 of the RTI-Act, 2005, and hereby directs the CPIO to take action as mandated
under the RTI-Act, 2005.
3. Since the PIO has failed to respond to the RTI-application mentioned above in time, he/she
is, therefore, required to send his/her explanation in writing by 17/06/2010 to show cause as to
why a penalty of Rs.25,000/-for delay in supply of information may not be levied upon him/her.
He/she should also appear before this Commission at the above address on 24/06/2010 at 03:15
pm along with all the relevant files/documents.
4. For this hearing, he/she may bring along with him/her other officials whose assistance has
been sought for replying to the RTI-application.
5. In case the complainant does not receive the desired information by 17/06/2010, in
response to the present order of the Commission, he may also be present during the hearing to be
held on 24/06/2010 at 03:15 pm.
