Background
1. The Applicant filed an RTI application dt.31.12.08 with the CPIO, NCR, Jhansi.
He requested for information against 3 points related to a complaint filed with
the office of Divisional Railway Manager on 13.12.2007 against Chief Ticket
Examiner, Jhansi. He wanted the action taken report on this complaint till
date and asked for photocopies of the report. The CPIO replied on 10.1.08.
Not satisfied with the reply, the Applicant filed an appeal dt.4.2.08 with the
Appellate Authority. The Appellate Authority replied on 18.2.08. Aggrieved
with the reply, the Applicant filed a second appeal dt.21.5.08 before CIC.
2. The Bench of Mrs. Annapurna Dixit, Information Commissioner, scheduled the
hearing for May 14, 2009.
3. Mr. Sandip Trivedi, Sr. DPO, Jhansi cum CPIO, Mr. Raghuvir Singh, DEM and
Mr. R.P. Pal, CLA represented the Public Authority.
4. The Applicant was present during the hearing.
Decision
5. Information against Point No.(i) has been provided. With regard to point
No.(ii), the Commission holds that since the Applicant is only asking for the
opinion of the Respondent on certain matters, the information cannot be
provided since it does not fall under the definition of information as given in
the RTI Act. The Commission also holds that all the available information has
been provided and accordingly disposes off the appeal.
