Facts
arising from the Complaint:
Mohd. Taj filed a RTI application with the PIO, MCD, Town Hall, New Delhi- 110006 on
31/05/2010. However, on not having received the information within the mandated time, the
Complainant filed a complaint under Section 18 of the RTI Act with the Commission. On this basis, the
Commission issued a notice to the PIO, O/o Commissioner, MCD, Town Hall, Delhi, on 07/07/2010
with a direction to provide the information to the Complainant and further sought an explanation for not
furnishing the information within the mandated time.
The Commission received a letter dated 02/08/2010 from the APIO & EE (M) IV, Central Zone,
MCD, Road No. 7, Anderwej Gang, New Delhi, wherein it was stated that the initial complaint and the
RTI Application dated 31/05/2010 was not received in their office. Further, it was also submitted that
the MCD did not carry out any developmental works in such unauthorized colonies, which is the subject
matter of the RTI Application, and works are being carried out by either the DSIIDC or the Flood
Control & Irrigation Deptt. GNCTD and not the MCD.
Decision:
The Complaint is allowed.
In view of the aforesaid, the APIO & EE (M) IV, Central Zone, MCD, Road No. 7, Anderwej
Gang, New Delhi is directed to transfer the said RTI Application dated 31/05/2010 to the DSIIDC and
the Flood Control & Irrigation Deptt., GNCTD, under Section 6(3) of the RTI Act, 2005 by 20/09/2010.
Notice of this decision be given free of cost to the parties.
Any information in compliance with this order will be provided free of cost as per section 7(6) of RTI, Act, 2005
