Facts
arising from the Complaint:
Mr. Irshad Khan had filed a RTI application with the PIO, MCD, Shahadara
North Zone on 14/12/2009 asking for certain information. However, on not having
received any further information within the mandated time, the Complainant filed a
complaint under Section 18 of the RTI Act with the Commission. On this basis, the
Commission issued a notice to the PIO, MCD, Shahadara North Zone on 12/02/2010 with
a direction to provide the information to the Complainant and further sought an
explanation for not furnishing the information within the mandated time.
The Commission has received a letter dated 09/03/2010 from the deemed
PIO/Executive Engineer (M. Shah. North)-II stating that information has been provided
to the Complainant vide letter(s) dated 05/01/2010 and 04/03/2010. Copy of the
information and proof of dispatch were enclosed. On perusal of the information it has
been observed that information provided on Query No. 5 is incomplete. Second part of
the said query has not been addressed by the PIO. The PIO should provide information on
any such procedure that exists for the public to get samples checked.
Decision:
The Complaint is allowed.
In view of the aforesaid, the deemed PIO is hereby directed to provide complete
information with regard to Query No.5 as mentioned above to the Complainant before
13/05/2010 with a copy to the Commission.
Notice of this decision be given free of cost to the parties.
Any information in compliance with this order will be provided free of cost as per section 7(6) of RTI, Act,
2005.
