On behalf of the Respondent the following are present:-

There are two cases, one an appeal and the other a complaint, filed by the
same person. Both have been taken up for hearing together.
The brief facts of the case is before us are as under:
2. In one case, the Complainant had requested the CPIO, in his letter of 8
June 2007, seeking copies of certain documents. The CPIO never responded to
his request. He also filed an appeal before the first Appellate Authority. The
Appellate Authority transferred his appeal to a new Appellate Authority, but no
further action was taken by that Authority to decide his appeal. In the other case,
he had applied for information on 2 March 2007 to which the CPIO replied in his
letter dated 19 April 2007. He had also filed an appeal before the first Appellate
Authority which that Authority decided in his order dated 3 July 2007. Not
satisfied with the reply, he has preferred a second appeal before this Commission.
3. During the hearing, we heard the submissions of both the sides. We also
carefully examined all the documents enclosed with the appeal as well as with the
complaint. The Respondent produced in writing comments on the request for
information filed by the Complainant on 8 June 2007. Though the CPIO has
provided a number of documents to the Complainant/Appellant, he does not find
many of those documents relevant or satisfactory. Mainly, he is not satisfied that
the CPIO had not given him a copy of that communication based on which, in the
year 1999, the recruiting agency had refused to treat his certificate obtained from
the Hindi Vidyapeeth, Deoghar as equivalent to such qualification as required for
employment under the Central Government. We, therefore, direct the CPIO
concerned to provide him with a copy of the relevant Ministry of Defence or Army
Headquarters circular, in vogue in the year 1999, laying down the equivalence of
certificates issued by private and voluntary educational institutions like the Hindi
Vidyapeeth within 10 working days from the receipt of this order.
4. With the above observations, we dispose of both the complaint and the
appeal. Copies of this order be given free of cost to the parties.
