Background

1. The Applicant filed an RTI application dated 21.05.09 with the CPIO, Central
Council of Indian Medicine, New Delhi seeking the number of Ayurvedic
Colleges in India which have not been approved by CCIM despite fulfilling the
required criteria and also the number of colleges which have been approved
by the CCIM first and subsequently the No Objection certificates have been
obtained from the State Government. The CPIO replied vide letter dated
09.07.09 providing information and also enclosed some documents. Being
dissatisfied by the Respondent Authority’s reply, the Appellant filed a
Complaint before the CIC on 21.07.09 reiterating his request for information.

2. The Bench of Mrs. Annapurna Dixit, Information Commissioner, scheduled the
hearing on 18th September, 2009.

3. Mr. Subhe Singh, AS [Admin] and PIO was present on behalf of the
Respondent Public Authority during the hearing.

4. The Applicant was represented by Mr. Mohd. Tahir during the hearing.

Decision

5. The Appellant reiterated his RTI request while addressing his oral arguments.

The Respondent stated that no list of college/s as sought against point no. 1 is
available with the CCIM and with regard to second point, no college/s were
recognised before receiving NOC from the State Government. It was then
agreed that the Appellant would provide the specific names of colleges with
respect to point no. 1 to facilitate the CPIO in furnishing the information. The
CPIO to provide the year since when rules were changed with regard to
approval of colleges from CCIM to the Ministry and also the Rule in this
regard. The CPIO is also directed to allow inspection of records by the
Appellant for information against both points. All information to be provided
by 20.10.09. The Commission deems it a fit case for issuance of Show Cause
notice as to why penalty of Rs. 250/- per day may not be imposed upon the
CPIO for the delay in reply to the RTI application.
