Background
1. The Appellant filed an RTI request dt.10.7.08 with the CPIO, BSNL, Nagpur.
The Appellant requested for the following information:
a) Copy of details about Mr.Prashant Landge (appointed on
date:11.12.2000 under compassionate ground in Nagpur SSA, on post:TOA
now serving in PGMT, Zero Mile, Nagpur) regarding his date of application of
compassionate appointment, date of death of ex-official, date of settlement of
family pension, date of settlement of terminal benefits amount, date of
appointment in BSNL, MH circle (Nagpur SSA), Dependant family members,
residential address while applying for CGA, welfare report copy, Name of HPC
committee members whom they had considered his CGA case, Name of
welfare officer whom he/she had made a welfare report.
b) Copy of name of re-considered compassionate candidates after
rejected them by the BSNL, MH circle and re-considered again by the BSNL,
MH circle under DoPT guidelines from 1999 to 2008 of Nagpur SSA.
The CPIO replied on 2.8.08 stating that since no over riding public interest is
involved in requesting for such personal information of a third party has been
made out in RTI application, the same is exempted under Section 8(1)(j) of
the RTI Act with regard to point a and enclosing the list of rejected candidates
with regard to point b. The Appellant filed an appeal dt.18.8.08 sating that
he has not received the information within the prescribed time limit. The
Appellant filed a second appeal dt.2.9.08 before CIC.
2. The Bench of Mrs. Annapurna Dixit, Information Commissioner, scheduled the
hearing on February 5, 2009.
3. Both the Appellant and the Respondents were absent at the hearing.
Decision
4. The Commission directs the CPIO to provide information based on the
comments of the Appellant in his 2nd appeal, within 15 days of receipt of this
Order. (A copy of the 2nd appeal is enclosed).
5. The appeal is disposed off.
