Facts

arising from the Complaint:

Mr. P.K. Sharma had filed a RTI application with the PIO, Motilal Nehru College, New
Delhi, on 10/12/2008 asking for certain information. The appellant filed a complaint before the
Commission against the College, citing denial of information on 21/02/2009. The Commission
issued a notice to the PIO on 27/02/2009 asking him to supply the information by 27/03/2009
and sought an explanation for not furnishing the information within the mandated time. The PIO
has informed the Commission that they wrote to the appellant vide letter dated 09/01/2009,
stating, “refer to your application dated 11/12/2008 under RTI Act 2005, in this regard some of
the information as submitted by accounts section to the undersigned is available for your
inspection. You are requested to intimate the under signed about two days out of which one can
be fixed up for inspection at your end. With regard to, other informations as and when the same
will be made available to the undersigned from the concerned officials, it will be informed to
you.” To which the applicant replied vide letter dated 14/01/2009 that, “he never demanded any
inspection but the certified copies of the documents which you have not supplied till date.”

The facts came into Commissions knowledge that, the appellant concealed important
facts in front of Commission, while filing the complaint under Section 18 of the RTI Act, 2005.
There is no mention any communication from the PIO in his complaint, which implies that the
appellant is malafidely acting and misleading the Commission.

Decision:

Complaint dismissed.

Notice of this decision be given free of cost to the parties.
