                                                   ORDER

 

  Sh. P. Suresh Babu, the Appellant, is aggrieved with the reply provided to him by 
the Respondent on point no. 5 & 7 of his RTI application  dated 31.08.2010.   In his 
second appeal filed before the Commission, the Appellant pleads for suitable direction by 
the Commission to the CPIO and FAA / Directorate of Co­ordination, Police  wireless, 
M/o Home Affairs, to provided correct and complete information to query no. 5 & 7 of 
his RTI application.

The   Respondent   on   the   other   hand   in   a   written   statement   filed   before   the 
Commission   deny   the   allegations   leveled   by   the   Appellant   and   state   that   requisite 
information a sought for by the Appellant under the RTI Act has been provided to him 
within the time limit as prescribed under the said Act. The information sought by the 
Appellant and the information provided by the Respondent are as follows:­
Information   sought  by  the  applicant under  Information provided by the CPIO and First 
point (5) Appellate Authority under para (5) as per the 
following clarification.

Is   it   true   that   an   Association   registered  Yes, it is true that Directorate of Coordination 
under   Society   Registration   Act   with   an  Police Wireless (MHA) is receiving / 
objective   of   representing   common  considering the representations / grievances 
submitted by an individual / employee / group 
grievances   of   staff,   is   allowed   /   permitted 
of employees/ registered Associations while 
Directorate of Coordination Police Wireless 
taken decision.

(MHA)   even   though   it   has   not   obtained 
recognition   under   Central   Civil   Service 
(Recognition of Service Association) Rules, 
1993.

Information   sought   by   the   applicant   under  Information provided by the CPIO and First 
point (7) Appellate Authority under para (7)

Whether   Akhil   Bhartiya   Operational   Staff  Information   as   sought   by   the   applicant   is 
Association   (Registered   under   society  available   in   Rule   7   of   the   CCS(Conduct) 
Registration Act, but non recognized as per  Rules, 1964 & the same was intimated by the 
CPIO & the Appellate authority vide letter No. 
CCS(RSA)   Rules,   1993   can   hold   peaceful 
A   13019/5   (Transfer)   /   2010­Admn.I   dated 
meetings   in   DCPW   office  premises   during 
27.09.2010   &   OM   dated   2.11.2010 
off   working   hours   without   hampering  respectively.
Government Works?”

After hearing the parties and on perusal of the relevant documents on file, the 
Commission is of the view that the requisite information as per record and permissible 
under the RTI Act has been provided to the Appellant by the Repondent on point no. 5&7 
of his RTI application, the Commission finds no infirmity in the reply of the respondent. 
However, in the interest of transparency the Respondent are hereby directed to provide a 
copy of Rule 7 of the CCS (Conduct) Rules 1964, to the Appellant within 10 days of 
receipt of this order.

The matter is disposed of on the part of the Commission.
