Facts
arising from the Complaint:
Mr. Y.N. Prasad, had filed a RTI application with the PIO, Delhi Legal Aid Service
Authority, Delhi, on 17/09/2007 & 11/04/2008 asking for certain information. Since no reply
was received within the mandated time of 30 days, he had filed a complaint under Section 18 to
the Commission.
The Commission issued a notice to the PIO asking him to supply the information and
sought an explanation for not furnishing the information within the mandated time. The PIO has
informed the Commission that as regards the RTI application dated 17/09/2007, the requisite fee
of Rs.10 was not received. As regards the second application dated 11/04/2008, the PIO states
that no such application was received, and only a photocopy of it received before the First
Appellate Authority. However, the PIO has informed the Commission that the information
pertaining to both has been sent to the complainant on 22/02/2009.
Commission’s Decision dated 10/02/2009:
“Complaint Disposed Off.
The Commission condones the delay and warns the PIO to ensure that information is
given to applicants within 30 days as mandated under Section 7 (1) of the RTI act. The
complainant is directed that in the future he should accompany any RTI applications filed with
the requisite fee as mandated by the RTI Act.”
Facts leading to hearing on 24 September 2009:
The Commission had received a letter dated 05/08/2009 from Mr. Prasad YN, wherein he had
alleged that certain facts, based on which the Commission gave its decision dated 10/02/2009,
have been wrongly stated by the PIO. The Commission had vide its decision dated 10/02/2009
disposed off the Complaint as the PIO had informed the Commission that he had not received
Rs.10/- as fee along with the First RTI application dated 17/09/2008 and the second RTI
application dated 11/04/2008 was not received by the PIO. Hence the Commission decided to
hear this matter on 24 September 2009 at 4.00pm.
Relevant Facts emerging during Hearing on 24 September 2009:
The following were present:
Complainant: Mr. Prasad Y.N.
Respondent: Mr. D.R.S.Thakur, PIO
The Complainant had filed RTI application and sent a money order with it. It is difficult for any
Government Officer to link money order with any RTI application and therefore the reply was
not provided. The Complainant has also filed another RTI application where he has sent an IPO
of Rs.10/- in the name of the PIO which is not as per the Rules. The Complainant is now keep
insisting that he wants grievance in both the case as whey there was delay in replying. The
reasons have been explained to him and there are no reasons on record. Thus there is no
information that the Complainant seeks as defined under Section 2(f) of the RTI Act. The
Complainant was asked by the Commission if he was willing to identify any information which
he wishes to get from the PIO but he refused to identify any such information.
Decision:
In view of this the Complaint is disposed off.
