Facts
arising from the Complaint:
The Complainant had filed a RTI application dated 25/07/2011 with the PIO,
MCD Civic Centre asking for certain information. Since no reply was received within the
mandated time period of 30 days, the Complainant filed a Complaint under Section 18 of
the RTI Act with the Commission. On this basis, the Commission issued a notice
directing Respondent on 09/09/2011 to provide information to the Complainant and
further sought an explanation for not furnishing the information within the mandated
time.
Subsequently, the Commission received a copy of the letter dated 26/09/2011,
addressed to the Complainant, from the Respondent No. 1, wherein, it has been stated
that the RTI application dated 26/07/2011 was transferred to the AC, South Zone vide
transfer ID No. 7481 dated 27/07/2011. Further, it has been stated that on request of the
Building (HQ) a photocopy of the complaint dated 06/07/2011, RTI Application dated
25/07/2011 and transfer letter have been provided to the office of the Respondent by the
AC/APIO, City zone. On perusal of the records it has been observed that the Respondent
No. 1 in his reply states that the complaint letter dated 06/07/2011 on which the
Complainant had sought information was transferred to the PIO, Town Planning
Department, Civic Centre MCD on 08/07/2011 for providing information to the
Complainant. However the Commission has not received any reply/submission from PIO,
Town Planning Department, Civic Centre MCD.
Decision:
The Complaint is allowed.
In view of the aforesaid, the Commission directs the PIO, Town Planning Department,
Civic Centre MCD to provide complete information to the Complainant in regard to the
RTI Application dated 25/07/2011 before 09/12/2011 with a copy to the Commission.
If the information has already been supplied to the complainant, furnish a copy of the
same to the Commission with your written submission.
Notice of this decision be given free of cost to the parties.
Any information in compliance with this order will be provided free of cost as per section 7(6) of RTI, Act, 2005.
