               It may be recalled that the above mentioned matters were disposed of by
this Commission on 11.3.2010 wherein the Commission had directed the CPIO to provide
copy of the Log Book and hard copy of the photographs recorded in the CD to the
appellant. Col. Dubey is present before the Commission on behalf of the appellant in
connection with some other matter. He complains that the order of the Commission has
not been fully complied with in as much as while the log book has been given to him, the
hard copy of the photographs contained in the CD has not been supplied to him.

2.     On the other hand, Lt. Col. Paresh Kumar of JRC, Bareilly, would submit that
hard copy of the photographs contained in the CD has already been provided to the
appellant. Besides, a copy of the CD was earlier provided to her.

3.     Col. Dubey , however, is not satisfied with it. It is his suspicion that certain
photographs recorded in the CD are being held back from him by the Public Authority.
Lt. Col. Paresh Kumar, however, repels this suggestion and categorically asserts that
whatever photographs were contained in the CD, have been provided to the appellant. He
would add that the memory card of the digital camera was sent to an expert at Gurgaon
and he was not able to retrieve any additional photographs.

                                            DECISION

4.      Whether or not any additional photographs are available with the Public Authority
either in hard copy or in the CD, it is for it to determine. Lt. Col. Paresh Kumar is hereby
directed to revisit the matter and if any additional photographs are available with the
Public Authority in any media, the same should be provided to the appellant. In case
there are no additional photographs, he may file an affidavit before this Commission in
03 weeks time.
