Background
1. The Applicant filed his RTI application on 08.04.09 with the PIO/ L.H.M.C. &
S.K. Hospital, New Delhi seeking the details of dues paid to employees who
had expired one year after 01.01.03 till date including name, date of
retirement, link insurance, leave encashment, gratuity, reasons for delay of
payment, etc. The CPIO replied on 06.05.09 requesting the Applicant to
deposit Rs.50/- towards the supply of information. The information sought
was provided to the Appellant for one year. Not satisfied with the reply, the
Appellant filed his First Appeal on 29.05.09 stating that no information has
been provided to him although the time limit has been crossed. The Appellate
Authority replied on 30.05.09 and 08.07.09 stating that the Appellant dated
29.05.09 has been considered and it was found that no specific information
has been sought in it. Being aggrieved with the reply, the Appellant filed a
Second Appeal before the CIC on 25.07.09.
2. The Bench of Mrs. Annapurna Dixit, Information Commissioner scheduled the
hearing on 15th October, 2009.
3. Mr. Arun Chowdhury, D.D.A and Dr. G.K. Sharma, Director represented the
Public Authority.
4. The Applicant was present during the hearing.
Decision
5. The Respondent stated that the information has sought by the Appellant in
the format given by him and that the information was provided for a period of
one year. However, the Appellant had requested for information for six years
and according to the Respondent, with the staff available with the Hospital,
the exercise of collecting the information from the files would be enormous
and would disproportionately divert resources of the Hospital. The Appellant
submitted that he would be satisfied with the information for the last three
years. The Commission, while observing that the information is available in
the files, directs CPIO to allow inspection of files pertaining to the information
sought for the remaining two years, by the Appellant and to provide him with
certified copies of documents he requires, after severing under Section 10(1)
of the RTI Act, 2005 (if required) that part of the information which is exempt
from disclosure. The Appeal is accordingly disposed off.
