Background
1. The Applicant filed an RTI application dt.24.7.08 with the CPIO, SR, Chennai.
He requested for the following information:
i) Extract of the T.A Journals of Mr.Janarthanan CVI/MAS for the month
of Feb.07 and Mar.07.
ii) Standard format of No claims certificate by the contractor for
refunding of security deposit at the end of each engineering contract work
either by quotation work order issued by Railway or by way of agreement
between Railway and contractor.
iii) All connected circulars/letters regarding issuing of No claims certificate
by the contractor for refunding of security deposit at the end of Engineering
Contract work either by Quotation work order issued by Railway or by the way
of agreement between Railway and Contractor.
iv) Orders of Sr.DCM/SA terminating Mr.C.M.Ramesh,
Contractor/Licensee, Cycle stand at Bommidi.
The APIO replied on 27.8.08 stating that Mr.T.Janarthanan CVI/HQ has
expressed his objection to furnish the information. The PIO & DPO replied on
28.8.08 enclosing the information sought by the applicant w.r.t points (ii) and
(iii). The applicant filed an appeal dt.5.9.08 with the Appellate Authority. On
not receiving any reply, he filed a second appeal dt.24.10.08 before CIC.
2. The Bench of Mrs. Annapurna Dixit, Information Commissioner, scheduled the
hearing for June 19, 2009.
3. Mr. A.P. Mishra, AGM, Ms. Sunita Vendantam, CPO, Mr. K. Bhuvaneshwari,
DY. CVO and Mr.B. Nageswara Rao represented the Public Authority.
4. The Applicant was not present during the hearing.
Decision
5. The Respondent submitted that point No.1 relates to the movement of the
Vigilance Inspector and that this information cannot be disclosed since it is
confidential in nature. Information against Point 2 and 4 has been provided.
With regard to information against Point No.3, the Commission directs the
CPIO to forward the RTI request to CPIO, Southern Railway, Salem with a
request to provide the information directly to the Appellant by the end of July,
2009. Information against point 1 is denied under Section 8(1)(h) of the RTI
Act.
6. The appeal is accordingly disposed of.
