                                                        ORDER
Background
1. The Applicant filed an RTI Application dt.23.2.11 with the PIO, Delhi Secretariat. He stated that he
had applied for a flat in the Residential Flats/Plots Registration Scheme for Slum Dwellers and other
– 1985 vide application No.2666 and priority No.18807/G. In this context, he sought information
against eleven points including whether land is available with MCD/Delhi Govt. for above said
scheme and why without arrangement of land, applications had been called from the general public.
He also wanted to know the reasons as to why the above said scheme had been transferred to MCD
by DDA. The PIO replied on 25.3.11 furnishing point wise information. Not satisfied with the reply,
the Applicant filed an appeal dt.25.4.11 with the Appellate Authority commenting on the information
provided against points 1, 6, 7, 8 and 10 and seeking the correct information against these points.
The Appellate Authority replied on 13.6.11 stating that the Applicant was present at the hearing held
by him and that he had declined to sign the attendance sheet. He added that the Applicant wanted
the actual time/date by which he would be allotted a flat and that Applicant was informed that the
same cannot be provided as it depends upon availability of land and period of construction which
cannot be anticipated. Being aggrieved with the reply, the Applicant filed a second appeal dt.13.7.11
before CIC.
Decision
2. In the absence of the Appellant, it was decided to dispose of the appeal based on the written
submissions by the Appellant as available on record and the submissions by the Respondents .
Accordingly, the information sought against points 1, 6, 7, 8 and 10 were discussed as given
below. .
 Points 1 & 6
The Respondents submitted that the land acquisition is almost complete  and that this fact has been 
confirmed by the Revenue Department in a report submitted to them.
The Commission directs the PIO to provide a copy of the this report to the Appellant on payment of
the prescribed photocopying charges.
Point 7
The Respondents submitted that the scheme referred to in the instant case was not transferred from
DDA to MCD. Rather it was the Department dealing with development of slums and JJ colonies that
was first under the jurisdiction of DDA and then was transferred to MCD and then back to DDA and
finally was converted to Delhi Urban Shelter Improvement Board. He added that even though the
controlling office has changed several times, the scheme has remained unchanged.
The PIO is directed to formally explain this matter to the Appellant and also to share with him copies
of orders of transfer to DDA and back.
Points 8 & 10
The Commission holds that adequate information has been provided against these points and that no
further disclosure is required.
The information to be provided by 3.12.11 and the Appellant to submit a compliance report to the
Commission by 10.12.11.
3. The appeal is disposed of with the above directions.
