Facts

:-

Heard today. Appellant not present. The Department is represented by
Shri Jagan Nath Baitha, Superintendent, Post Offices, Madhubani.

2. From the RTI application, it appears that the appellant had sought status
report about the complaint dated 14.3.2009 lodged by certain persons against
Branch Post Master, Kaithnia, District Madhubani. The CPIO had informed the
appellant vide letter dated 6.11.2009 that the complaint had been inquired into
and was found to be false.

3. On appeal, the Appellate Authority, however, had taken a different view.
He was of the opinion that the query raised in the RTI application did not fall in
the ambit of RTI Act.

4. We have heard Shri Baitha. We have also gone through the material on
record, including, the Inquiry Report submitted by Shri S.K. Mishra, Inspector of
Posts. We are constrained to remark that the Appellate Authority’s conclusion
that the query raised by the appellant does not fall in the ambit of RTI Act is not
correct. The appellant is entitled to know the outcome of the complaint. Even
though he has already been informed that the complaint has been found to be
false, it would be appropriate to send him a copy of the Inquiry Report in 03
weeks time.

5. The matter is decided accordingly.
