Background
1. The Applicant filed an RTI request dt.2.9.08 with the CPIO, BSNL, Lucknow.
He wanted to know against which password/user id and against whose name
the ISD services were provided to him. The CPIO replied on 18.11.08
providing point wise information. Not satisfied with the information. the
applicant filed a complaint dt.9.12.08 before the CIC.
2. The Bench of Mrs. Annapurna Dixit, Information Commissioner, scheduled the
hearing for February 19, 2009.
3. Mr.Chandra Bhushan Sing, TDM & CPIO represented the Public Authority.
4. The Applicant Mr.Ramesh Chandra Bhatt was present in person along with his
representative Mr.Rama Shanker during the hearing.
Decision
5. The applicant informed that the ISD service was opened in July 2003 but was
not activated since he was not provided with a password/user ID. However,
from July 2003 to Sept.2003, the ISD was activated even though he was not
given the user ID/password. The respondent stated that he had provided the
user ID. However, he was unable to find the date on which the user
ID/password was provided. The Appellant’s contention was that the date
was known to the Respondent.
6. The Commission directs the CPIO to provide the information sought in the RTI
request within 20 days of receipt of this Order. In the event, the information
is not available; the CPIO to provide an affidavit signed by the Appellate
Authority stating that information sought is not available.
7. The appeal is disposed off.
