1 The Bench of Mrs. Annapurna Dixit, Information Commissioner, scheduled the
hearing for 7th September, 2009.
2 Mr. Pradeep Kishore, ASP (HQ), Mr. Vijay Pal, O/A was represented to the
Public Authority.
3 The Applicant was not present during the hearing.
Decision
4. The Respondent submitted that the required information was sent by the
CPIO on 06.11.08 but was returned to the office with the remark stating that
the addressee was not residing at the given address. Once again on 13.04.09
the information was sent but again returned with the remark that the
Addressee had gone out of town for some time. He also stated that a letter
was sent on 28.04.09 informing the Appellant about the non delivery of the
registered letter and requesting him to collect the information from the O/o
the SSPOs, Saharanpur. The letter was also sent to SDI West, Saharanpur to
be delivered at the same address. The SDI West again informed on 01.05.09
that the letter could not be delivered as the family members refused to take
that letter. In the light of this submission, the Commission accepts the
explanation for non furnishing of information as reasonable and directs the
CPIO to send the information one more time to reach the Appellant before
end of September 2009 and holds that there was no deliberate attempt at
withholding any information..
5. The complaint regarding non-compliance of the Order mentioned hereinabove
accordingly has no merit.
