ORDER
Background
1. The Applicant filed an RTI Application dt.20.10.10 with the PIO, Railway Board seeking copies of the
representation submitted by Shri S.C.Pandey to treat him as regularly promoted as ASC based on AP
High Court judgment in W.P No.5763 of 1989 filed by Shri Dharam Vir Singh and further information
related to Shri S.C.Pandey and inspection of the relevant files. The PIO replied on 21.12.10
enclosing information furnished by Dr.S.N.Pandey, Director/RPF who stated in his letter that he is
enclosing copies of relevant documents . The Applicant filed an appeal dt.27.12.10 with the
Appellate Authority stating that the copies have not been enclosed along withy the covering letter.
On not receiving any further response, the Applicant filed a complaint dt.18.7.11 before CIC.
Decision
2. During the hearing, the Respondents submitted that the documents had indeed been enclosed with
the PIO’s reply and also that the first appeal was not received by them. Hence they could not provide the
documents once again. He, however added that the noting portions have already been received by the
Complainant and that the information that could not be located initially, was found after extensive search and
that the entire set of documents including the missing information were dispatched to the Complainant on
19.10.11.
3. Since the information has been provided , there is no need for any further disclosure. The appeal is
disposed off accordingly.
