         The Complainant was present along with Shri Atul Gulati.

         On behalf of the Respondent, the following were present:­

2. This  case was  fixed for  hearing today to hear the  explanation of  the 

CPIO   regarding   the   delay   on   his   part   in   providing   the   information   to   the 

Complainant.     Both   the   parties   were   present   and   made   their   submissions. 

Looking  to   the  voluminous information  sought  by  the  Complainant, the  final 

reply of the CPIO dated 4 November 2009 cannot be said to be unreasonably 

delayed and, therefore, we do not intend to impose any penalty on the CPIO.

3. However, in regard to the information sought, the Complainant stated 

that she was yet to get the copies of the relevant records.   In response, the 

Respondents   submitted   that   the   desired   information   pertained   to   a   case 

pending before the competent Tribunal for Recovery of a loan sanctioned to the 

Complainant and that much of the records related to the loan case had already 

been provided to her.  

4. In the background of the above, we are of the view that the CPIO should 

make   a   complete   list   of   all   the   information/records   being   sought   by   the 

Complainant   not   only   in   the   present   RTI­application   but   in   all   other   RTI­

applications currently pending with the CPIO and provide the copies of all the 

relevant records relating to each of the queries in these applications, excluding, 

however,   those   which   are   already   in   the   possession   of   the   Complainant 

procured through various proceedings pending before and decided by various 

Law Courts and Tribunals.  The CPIO shall prepare a statement of the desired 

records   and   mark   against   each   if   it   is   already   in   the   possession   of   the 

Complainant   so   that,   at   a   glance,   it   would   be   clear   which   documents   are 

already with the Complainant and which are being provided by the CPIO afresh. 

We direct the CPIO that this be completed within 15 working days from the 

receipt of this order.  

5. Copies of this order be given free of cost to the parties.
