Background
1. The RTI application was filed by the Applicant on 19.2.09 with the PIO, WC Railway, Jabalpur
seeking information about the decision on the letters submitted by him dated 18.12.07 and 19.8.08 for
balance available in the Foot to Foot survey report. The PIO replied on 26.3.09 providing information
after taking additional fee of Rs.28/ containing the description of the case contained in 14 pages.
Not satisfied, the Applicant filed his first appeal on 12.4.09 seeking the same information to which the
Appellate Authority replied on 15.2.10 stating that since the matter is subjudice the GM is not in a
position to take a decision. Being aggrieved with this reply, the Appellant filed his second appeal
with the Commission on 15.5.10 seeking the same information once again.
2. The Bench of Mrs. Annapurna Dixit, Information Commissioner, scheduled the hearing for August 16,
2010.
3. Shri Ajay Srivastava, PIO and Shri M.G. Hardas, APIO represented the Public Authority through
video conferencing.
4. The Applicant was present during the hearing.
Decision
5. During the hearing the Appellant requested for the decisions taken on his 2 letters mentioned in the
RTI application. It was noted by the Commission that he had already been informed that the subject matter in
his two letters on which decision had to be taken is at present subjudice and that the General Manager will
have to wait for the Court’s verdict before any decision can be taken on the matter contained in the 2 letters.
The Respondent also submitted that he had facilitated the Appellant in filing of the case in the Grievance Cell
so that his grievance can be redressed. Since available information has been provided to the Appellant, the
appeal is accordingly disposed of .
6. The case is closed at the Commission’s end.
