arising from the Complaint:
Mr. Charan Yogi had filed a 2 RTI applications with the PIO, MCD, West Zone,
, on 25/05/2010 asking for certain information. However on not having received the
information within the mandated time, the Complainant filed a complaint under Section
18 of the RTI Act with the Commission. On this basis, the Commission issued a notice to
the PIO, O/o Asstt. Commissioner, WZ, on 08/09/2010 with a direction to provide the
information to the Complainant and further sought an explanation for not furnishing the
information within the mandated time.
The Commission received a letter dated 30/09/2010 from the PIO & AC, WZ,
wherein it was stated that amongst the 2 RTI Applications, under section 6(3) of RTI Act,
one was transferred to the SEI, WZ and the other application was transferred to the IT
Department who were the custodians of the infromation. It was further stated that the
Complainant appeared before the PIO in their office and the necessary information was
provided to him verbally and in writing separately thereafter; the Complainant also made
an endorsement of having received the information sought by him. Further, it is also
pertinent to note that the Commission had a telephonic conversation with the
Complainant wherein the above mentioned was affirmed by him. Therefore, on perusal of
documents, and keeping the above said in mind, the Commission observes that the sought
information was provided to the Complainant by the PIO.
Decision:
The Complaint is disposed.
Notice of this decision be given free of cost to the parties.
Any information in compliance with this order will be provided free of cost as per section 7(6) of RTI, Act, 2005.
