Background
1. The Applicant filed an RTI application dated 20.10.08 with the CPIO/BSNL, New
Delhi, seeking information about the payment made to one Senior Advocate of
Supreme Court, for appearing on 28.04.05 and 11.05.05 before the High Court
and Supreme Court respectively. The said Advocate was hired by the Department
in addition to regular counsel and ASG etc, for getting stay against the contempt
proceeding. According to the Applicant this was clearly misuse of public money on
one hand and on the other hand it was intended to harass this Applicant. The
CPIO replied on 19.11.08 informing the Applicant that no payment has been
made in this case by Station Director, All India Radio, Jaipur. Being aggrieved by
the order of the CPIO, the Applicant herein filed a First Appeal before the
Appellate Authority on 29.11.08 reiterating the contentions as made in the RTI
application. The First Appellate Authority replied on 23.12.08 refusing to supply
the information as no such paymen has been made. Being repeatedly denied
information by the Respondent Authority a Second Appeal was filed before the
CIC by the Applicant, on 27.03.09.
2. The Bench of Mrs. Annapurna Dixit, Information Commissioner, scheduled the
hearing on 14th September, 2009.
3. Mr. M D Sundri, Dy. Director of Administration and Mr. S R Pandey, Consultant
represented the Respondent Public Authority.
4. The Applicant was not present during the hearing.
Decision
5. The Respondent submitted that Mr. S.K. Misra, Senior Advocate of the Supreme
Court has not been paid for his services or others by either Director General, AIR
or by any Station Director of AIR. Since available information has been provided,
the Commission accordingly disposes of the appeal.
