                                        DECISION

       While deciding this appeal by a decision in Appeal No. 1446/ICPB/2008 dated
12.2.2008, a show-cause notice was also issued under section 20(1) of the Act. The
matter is now for consideration on the reply dated 12.3.2008 received from the CPIO to
the show-cause notice. I have gone through the reply provided by the CPIO.

2.      On scrutiny, it is found the CPIO has not provided proper explanation to the
show-cause notice issued by the Commission vide its decision in Appeal no.
1446/ICPB/2008. He is simply indicating that APIO has not received the RTI
Application, he has only received the appeal and he has not forwarded the same to
CPIO. This kind of excuse is not acceptable to the Commission. The CPIO is the
designated officer under RTI Act and the Bank may be evolving its own method for
receiving/processing of RTI application. The CPIO has failed to provide any information
to the appellant till the date of hearing. The CPIO is expected to provide information as
available with him after collection. If it is going to take more time he should send an
interim reply. This case has been delayed by more than 12 months. The CPIO has not
put-forth any cogent reasons for the delay. Therefore I have no alternative but to
impose a penalty of Rs. 10,000/- with a hope that he will be careful in future while
discharging his duties as CPIO. The concerned pay disbursing office has to recover the
amount in 5 installments from the salary starting from the pay of October, 2008. The AA
of this Zone should file reply before the Commission in this regard in the first week of
November, 2008.

       Let a copy of this decision be sent to the appellant and CPIO.
