The First Appellate Authority ordered: –
“Furthermore, the appellant wants some new documents including Plans/Maps
which were not asked in his original RTI application. For this, he may apply afresh to
the PIO.
Appellant stated that which information has been furnished to him, the same is
incorrect as not reflecting the actual situation on ground. This was contacted by
Department representatives. This is not forum to decide questions of actual field
condition or Revenue matters. If appellant feels that the answer furnished under RTI is
not reflective of actual ground condition, he may take up the matter with Estate
Department of DJB. I accordingly uphold order of PIO.”

The appellant contends that they believe the particular piece of land belongs to MCD.
The PIO has a paer showing that the land has been transferred to DJB by Defence. The
PIO is directed to give a copy of the paper evidencing this. He has given it to the
appellant.
Decision:
The Appeal is allowed.
The information is given to the appellant in front of the Commission.
This decision is announced in open chamber.
Notice of this decision be given free of cost to the parties.
