                                                    ORDER

  Sh.   S.   Natesan,   the   Appellant,   through   his   RTI   application   dated   8.09.2010 
requested for a copy of the opinion given to NCC / Education Department in respect of 
abolishing / amalgamation / re­designating of the erstwhile post of head clerk in NCC. As 
per the replies furnished by the Respondent CPIO and the FAA to the Appellant, they 
have been unable to provide the requisite information / documents since the information 
sought for by the Appellant relates to the year 1979, that is, 30 years old and in spite of 
their best efforts the relevant information could not be traced­out. Further, as has been 
pointed out by the First Appellate Authority (FAA) in his order, the CPIO vide letter 
dated 4.01.1979 has mentioned to the Appellant that the G.O. a copy of which has been 
requested   for   by   the   Appellant   was   notified   by   the   Education   Department,   Govt.   of 
Puducherry and not by the DP & AR. 

During the hearing the Respondent submit that this matter, in fact is not related to 
the DP & AR but to the Department of Education, Govt. of Puducherry. The notification 
has   been   issued   by   the   Department   of   Education   and   the   concerned   file,   including 
notings, if any, made by the DP & AR in the matter would be available in the concerned 
file of the department of Education, Govt. of Puducherry.

The Commission, finds merit in the contention of the Respondent, The CPIO DP 
&   AR   is   hereby   directed   to   transfer   the   application   to   the   concerned   CPIO   of   the 
Education Department, Govt. of Puducherry within 5 days of receipt of this order, under 
the provisions of Section 6(3) of the RTI Act, 2005. 

With these directions the matter is disposed of on the part of the Commission.
