Background

1. The Applicant filed an RTI application dt.27.2.09 with the CPIO, DoP,
Lucknow. He requested for information against 11 points including the
following:

i) Copy of notification for PA/SA Recruitment 2008 circulated under
C.O.No.Rectt/M.12/PA-SA/2/2008/6 dt.20.3.08

ii) Confirmatory slip pertaining to dispatch of CO letter dt.5.6.08 A/T
Smt. Nivedita Srivastava DPA and observer of Exam, Gorakhpur Centre and
Addl. Observer, Supervisor indicating date and time of dispatch from C.O and
date and time of receipt in R.O.Gorakhpur.
The CPIO & AD(Rectt.) replied on 26.3.09 furnishing information against
points (i to iii) and CPIO & APMG(Staff) replied on 9.4.09 providing
information to points (viii to xi). On not receiving the remaining information,
the Applicant filed a complaint dt.2.5.09 before CIC.

2. The Bench of Mrs. Annapurna Dixit, Information Commissioner, scheduled the
hearing for June 23, 2009.

3. The CPIO, DoP, U.P. Circle Lucknow authorized Shri G.P. Bajpai, ASP(Court)
vide his letter dated 17.6.2009 to represent at the hearing on his behalf.

4. The Applicant was not present during the hearing.

Decision

5. The Respondent explained that the documents which were not provided relate
to the selection of the Postal Assistant/Sorting Assistant which was done by
Mr. Tiwari. On the basis of irregularity conferred in the selection process a
case is pending against Mr. Tiwari and all these documents from 2 to 7 relate
to that selection process. Any disclosure of details of the process, would
influence the investigation process. He also added that the supervisory
certificate mentioned in point 5 is given by the Centre Supervisor about the
complete process of selection. This is also related to the selection process
and hence it has been denied. Perusal of the documents by the Commission
indicated that all other information has been provided to the Appellant. The
Commission upholds the decision of the CPIO with regard to non disclosure of
information against points 2 to 7 under section 8(i)(h).

6. The appeal is disposed off.
