Background
1. The Applicant filed an RTI application dt.27.10.08 with the CPIO, RPO, Delhi.
He requested for information with respect to passport of late Mr. Baba
Darshan Das. He added that the CPIO had earlier refused information saying
that it belongs to a third party whereas according to him it is not a third
party since he is the heir of Mr. Baba Darshan Das. The CPIO replied on
11.11.08 once again denying the information u/s 8(1)(j) stating that it is
third party information. Aggrieved with this reply, the Applicant filed an
appeal dt.8.12.08 with the Appellate Authority reiterating his request for the
information. The Appellate Authority replied on 4.2.09 upholding the decision
of the CPIO. The applicant filed a second appeal dt.15.4.09 before CIC.
2. The Bench of Mrs. Annapurna Dixit, Information Commissioner, scheduled the
hearing for May 26, 2009.
3. Mr.V.Mahalingam, PIO and Mr.Jimmy Simon, UDC represented the Public
Authority.
4. The Applicant was present during the hearing.
Decision
5. The Appellant stated that Late Mr. Darshan Das had left a will in which he
had bequeathed to him his property . He stated that some people are trying
to grab the property from him using unlawful means and that they had
produced in the court a photocopy of the last page of a passport allegedly
belonging to Mr. Darshan Das. In this connection, he stated that he would be
happy just to know whether the passport copy (No. U252153 with validity
extended upto 3.5.1989 and signed by the Regional Passport Officer, Delhi)
furnished to him by the court, actually is from Mr. Darshan Das’s passport or
not. The Commission, after hearing the Appellant’s submission, directs the
CPIO to inform the Appellant within a week whether the passport number
furnished by the Appellant is actually that of late Mr. Darshan Das or not,
by 10 June, 2009.
7. The appeal is disposed of.
