Background
1. The Applicant filed his RTI application dt.24.12.07 with CPIO, BSNL, Bhopal.
He requested for the following information: i) Details of diesel consumed in
engine alternator in Sagar SSA, ii)copy of log book of vehicle used by Mr.
Pankaj Gupta, iii)Copy of TA Bill of Mr. Pankaj Gupta, iv) copy of official order
and ruling of BSNL due to which salary of the Appellant was withheld and
copy of official order and ruling for disconnecting of Service telephone. The
CPIO replied on 20.1.08 and 22.1.08 stating that the information is being
compiled and will be provided as soon as it is ready. The applicant filed an
appeal dt.7.3.08 with the Appellate Authority. The applicant filed a second
appeal dt.6.12.08 before CIC.
2. The Bench of Mrs. Annapurna Dixit, Information Commissioner, scheduled the
hearing for February 27, 2009.
3. Mr. A.A. Khan, Asstt. Director represented the Public Authority.
4. The Applicant was not present during the hearing.
Decision
4. The Respondent in his rejoinder dt. 26.2.09 stated that the information was
called for from the Office of TDM, Sagar and was supplied to the Appellant on
1.4.08 against point 5 & 6 and information against remaining points was
denied under Section 8(1) (j) of the RTI Act 2005. He also stated that with
regard to log books and other related files, the Appellant has been invited
through several letters for inspection of the relevant documents for
information he required and the Appellant has not bothered to respond to the
invitation. After reviewing the information and noting the fact that the
Appellant had not responded to the invitation to inspect the log books and
relevant files etc., the Commission holds that all available information has
been provided and accordingly disposes off the appeal.
