Background
:
1. Mr. Santosh Kumar Jaiswal from UP filed an RTI application addressed to Sr. DCM and PIO,
Western Railway on 11.08.2009. The Applicant stated that his wife and her mother hadtraveled by a specific train (Gujarat Sampark Kranti no.2917) on 11.02.2009 from Ahmedabad
to Mathura and sought information regarding the date and the place where the tickets for the
same were booked along with the copy of the reservation ticket and reservation chart and
information on whether they had traveled by the same or not. The appeal was accordingly
transferred to SR. DCM, Ahemdabad Division for the supply of information. The PIO of
Ahmedabad Division in his letter dated 16.10.2009 stated that the reservation chart/form cannot
be provided as they are maintained only for a period of 6 months, which had passed.
Dissatisfied by the reply, the Applicant filed a First Appeal with the First Appellate Authority on
05.11.2009 requesting him to provide the information about whether the records of the Trains
no. 2917 were preserved or destroyed and whether the records of all the trains were reserved
for 6 months and for how long were these records kept with the railway. On not receiving any
reply from the First Appellate Authority, the Applicant filed the second appeal before the
Commission on 24.11.2009 requesting him to provide the information. The Applicant stated that
his wife had filed a Court Case accusing him of throwing her out of his house in Ahmedabad
and further added that it was a planned move of his wife and her mother and she had taken her
to her house at Agra and that he can prove his innocence only when the information is provided
to him by the Railways.
2. The Bench of Mrs. Annapurna Dixit scheduled the hearing for 10th June, 2010.
3. Mr. Dinesh Kumar Chachodia PIO, Western Railway represented the Public Authority and
was heard through video conferencing.
4. The Appellant was also heard through video conferencing.
Decision:
5. During the hearing the Commission noted that the Appellant after filing the RTI application, had
submitted the PNR number of the Rail ticket. The Respondent stated that it would be possible toretrieve the information sought by the Appellant from the computer database, based on the PNR
number, provided the information is still being maintained by the database section. The
Respondent also stated that the database is maintained at Chattrapati Shivaji Station Office and
also that there is a possibility that the details against the PNR may also be available at Delhi if
not in Mumbai.
6. The Commission accordingly directs the PIO, WR to transfer the RTI Application to the PIO of
the database office at Chattrapati Shivaji Station along with the PNR Number and directs thelatter to provide the sought information within 10 days of receipt of the RTI application.
7. The appeal is accordingly disposed of.
