Background
1. The Applicant filed an RTI application dt.2.9.08 with the CPIO, MTNL, New
Delhi. He requested for information against 4 points including photocopies of
two circulars of Central Vigilance Commission dated. 15.4.99 and 2.11.01,
details of existing sensitive posts, whether any one can be posted on these
posts for more than three years, details of officers who have worked on the
same post or section for more than 3, 5, 7 and 10 years and as per CVC
guidelines how long it will take to transfer these officers. The CPIO replied on
23.10.08 forwarding the guidelines provided by GM(Vig.) on 21.10.08. He
stated that according to CVC guidelines the officials posted at sensitive posts
are recommended to be transferred after three years. The CPIO also
forwarded on 11.12.08 information received from the GM(Admn.) giving the
list of sensitive posts in MTNL. Against points No.3 & 4, information was
provided by CPIO on 15.11.08 while enclosing the information received from
Asstt. GM(Admn.-Hqs). Not satisfied with the reply, the Applicant filed an
appeal dt.17.11.08 with the Appellate Authority. The Appellate Authority
replied on 22.12.08 stating that all information has been provided in earlier
letters. Aggrieved with this reply, the Applicant filed a second appeal
dt.13.1.09 before the CIC.
2. The Bench of Mrs. Annapurna Dixit, Information Commissioner, scheduled the
hearing for March 26, 2009.
3. Mr. Pramatma Rai, DGM(RTI) & CPIO, Mr. Harbhagwan, AGM(RTI-Appeal),
Ms. Rashmi, AVO(VA) and Mr. Vineet Sharma SDE(RTI) represented the
Public Authority.
4. The Applicant was not present during the hearing.
Decision
5. After reviewing the information provided and noting that information sought
against Point 3 is voluminous (almost 25000 officers and officials) and is also
spread across a large number of files, the Commission advises the Applicant
to be more specific about the information he requires in terms of the names
of the officers and the units in which they are posted and the CPIO to allow
inspection of relevant files by the Applicant for that specific information and
to provide the Appellant with certified copies of information he requires
before 15th April, 2009.
6. The appeal is disposed off.
