ORDER
Background
1. The Applicant filed an RTI application dt.10.7.10 with the PIO, North Central Railway, Allahabad
seeking information on the action taken on the Railway Board’s letter dt.17.12.09 and copies of the
order sheets. He also sought copy of the enquiry report if any. The Dy.CVO vide his letter dt 22.7.10
addressed to PIO stated that the vigilance section had gone through all the relevant records and had
found no irregularities because of which the competent authority had ordered closure of the case and
that during the enquiry, no written statements had been taken from any employee/official since it was
felt that there was no necessity for the same and hence there is no order sheet. Not satisfied with the
reply, the Applicant filed an appeal dt.3.8.10 with the Appellate Authority. Shri Alok Gupta, Appellate
Authority replied on 24.8.10 stating that information has already been furnished on 22.7.10.
Decision
2. During the hearing, the Respondents submitted that in compliance with the CIC Decision
No.4965/IC(A)/2009 dt.5.1.10 and CIC/AD/A/2009/001732 dt.9.2.10, on the same issue the Appellant
was invited to inspect the records who, however, did not avail this opportunity. The Appellant
submitted that he does not want to inspect the records and sought only the photocopies of call letters
dated 4.11.07, 18.10.08 and 10.12.08. He also sought his own answer booklet and OMR sheet.
Shri R.Meena, Member Secretary, RRB, Allahabad submitted that letter dated 4.11.07 is not
traceable and that the remaining information will be provided subject to its availability in the records.
3. The Commission after hearing the submissions of both sides directs the PIO to provide complete
information as sought by the Appellant during the hearing except for letter dated 4.11.07. With regard
to the enquiry report sought by the Appellant during the hearing the PIO is directed to provide the
same after invoking Sec.10(1) to sever the names of the examiners as well as information about
other candidates. The information should reach the Appellant by 10.3.11 and the Appellant to submit
a compliance report to the Commission by 16.3.11.
4. The appeal is disposed of with the above directions.
