Background
1. The Appellant filed an RTI application dt. 9.5.08 requesting for i) copy of the
report and comments furnished by Department of Medical Education, Health &
Drug, Govt. of Maharashtra to Ministry of Health & family Welfare,
Department of Health, Govt. of India, New Delhi and ii) copy of the report and
comments furnished by Medical Council of India to Ministry of Health & family
Welfare, Department of Health, Govt. of India, New Delhi. The CPIO replied
on 5.6.08 stating that comments against point 1 are awaited from Govt. of
Maharashtra and that information against point 2 relates to a third party and
that MCI has been requested whether they have any objection to disclose the
information. The Appellant filed his first appeal on 30.6.08 reiterating his
request for the information. Aggrieved at not receiving any reply from the
first Appellate Authority he preferred a second appeal on 8.9.08 before the
CIC.
2. The Bench of Mrs. Annapurna Dixit, Information Commissioner, scheduled the
hearing on January 29, 2009.
3. Dr. K.V.S. Rao, Depty. Secretary & CPIO represented the Public Authority.
4. The Appellant was not present during the hearing.
Decision
4. The Respondent submitted that all the information requested has been
provided to the Appellant and shared a copy of the information with the
Commission.
5. Since all available information has been provided, the Commission
accordingly disposes off the appeal.
