Background

1. The Applicant   filed his RTI application on 11.8.08 with the PIO, Railway Board.   He sought 

information against 3 points including when  action would be taken on his enclosed application 

and   why  the  construction of the over­bridge at Gaya had been stopped at the 2 nd  Railway 

Crossing and when the overall development of the area would be completed.  The APIO, Rly. 

Board replied on 17.6.08 informing the Applicant that the information sought is not available with 

the Rly. Board and requesting him to obtain the same from the Zonal Railways.  He enclosed a 

list of the PIOs of the Zonal Railways. Not satisfied with the reply, the Applicant filed his 1st 

appeal on 19.9.08 wherein he once again asked when   the development of the Gaya Junction 

and the area with the Staff quarters would be  undertaken and completed.   On not receiving any 

information   from   the   Appellate   Authority,   he   filed   his     2nd  appeal   before  the   Commission  .

2. The Bench of Mrs. Annapurna Dixit, Information Commissioner, scheduled the hearing for June 

16, 2010.  

3. Shri V.K. Samuel,  APIO, and Shri Om Prakash, Dy. Director, represented The Public Authority.

4.      The Applicant was not present during the hearing.

Decision

   5. The Respondent submitted that on 14.6.2010, in response to the 2 nd appeal, the Director (Coaching)­

2 had replied that the Appellant had only given certain suggestions in his application and has not 

sought any information as defined under section 2(f) of the RTI Act.

 6. I have gone through the RTI application as also the application enclosed with it by the Appellant and 

hold that the Appellant has indeed  not sought any information as defined under Section 2(f) of 

the RTI Act and accordingly reject the appeal.
